Welcome to Roamance! These Terms of Service ("Terms") govern your access to and use of our mobile application and website (collectively, the "Service"). By creating an account or using Roamance, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using Roamance, you agree to these Terms, our Privacy Policy, and Community Guidelines. We may update these Terms from time to time. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

To use Roamance, you must:

• Be at least 18 years old
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned from Roamance for violating our Terms or Community Guidelines

By creating an account, you confirm that you meet these requirements. We reserve the right to verify your age and identity.

3. Account Creation & Security

3.1 Account Registration

You may create an account using:

• Email and password
• Sign in with Apple

You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3.2 Identity Verification

We may require you to verify your identity using a government-issued ID. Identity verification is processed by third-party services (Stripe Identity). By verifying, you consent to the collection and use of your verified name and date of birth, which will be stored permanently to prevent fraud. Your verified name cannot be changed once set.

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of unauthorized access

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Premium Subscription

4.1 Premium Features

Roamance offers a Premium subscription for $4.99 per month, which includes:

• Unlimited hearts (swipes)
• See who liked you before swiping
• Unlimited backtracks (undo swipes)
• 5 profile boosts per month
• Featured Traveler status 1x per week
• Passport Mode (match in other locations)
• Daily Wanderers Picks
• Advanced filters
• Smart Photo Test
• See who viewed your profile
• Ad-free experience
• Priority matching algorithm

4.2 Billing & Renewal

• Subscriptions are billed monthly and auto-renew unless canceled
• You will be charged at the start of each billing cycle
• Payment is processed through the Apple App Store (for iOS) or Stripe (for web)
• Prices are subject to change with 30 days' notice

4.3 Cancellation & Refunds

• You can cancel your subscription anytime in your account settings
• Cancellation takes effect at the end of the current billing period
• You will retain Premium features until the end of the paid period
• No refunds for partial months or unused features
• For iOS subscriptions, manage cancellations through the App Store

5. User Conduct

5.1 Prohibited Conduct

You agree NOT to:

• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Use false information, fake photos, or create multiple accounts
• Harass, abuse, threaten, stalk, or intimidate other users
• Post sexually explicit, violent, hateful, or discriminatory content
• Solicit money or promote commercial activities (spam, scams, pyramid schemes)
• Share personal contact information publicly (phone numbers, addresses, financial info)
• Attempt to bypass identity verification or age restrictions
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or attempt to extract source code
• Violate any applicable laws or regulations

5.2 Content Guidelines

All user-generated content (photos, bio, messages) must comply with our Community Guidelines. We reserve the right to remove content that violates these Terms.

6. Content Ownership & License

6.1 Your Content

You retain ownership of content you upload (photos, bio, messages). By posting content, you grant Roamance a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and promoting the Service.

6.2 Our Content

All content and materials on Roamance (design, logo, software, text, graphics) are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

7. Account Termination

7.1 Termination by You

You may delete your account at any time from the app settings. Upon deletion, your profile will be removed within 30 days.

7.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our Community Guidelines
• We suspect fraudulent or illegal activity
• You are reported by multiple users
• Your account has been inactive for 90 days

Termination does not entitle you to a refund for Premium subscriptions.

8. Disclaimers & Limitation of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8.2 User Interactions

WE ARE NOT RESPONSIBLE FOR:

• Interactions, disputes, or relationships between users (online or offline)
• User-generated content (accuracy, truthfulness, legality)
• Third-party services (tour bookings, travel arrangements)
• Loss or theft of property during in-person meetings
• Physical or emotional harm resulting from user interactions

Important: Always exercise caution when meeting people from online platforms. Meet in public places, inform friends/family of your plans, and never share financial information.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAMANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify and hold harmless Roamance, its affiliates, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post on the Service

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

10.2 Arbitration Agreement

Any disputes arising from these Terms or your use of Roamance shall be resolved through binding arbitration, rather than in court, except where prohibited by law. You waive your right to a jury trial or to participate in a class action lawsuit.

10.3 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.

11. Apple-Specific Terms

If you access Roamance through the Apple App Store, the following additional terms apply:

• These Terms are between you and Roamance, not Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the Service.
• In the event of a failure to conform to any warranty, you may notify Apple for a refund. Apple has no other warranty obligation.
• Apple is not responsible for addressing claims related to the Service (product liability, legal compliance, intellectual property infringement).
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
• You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Roamance.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

12.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

12.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
